MAGNUSSON REPRESENTS THE E-COMMERCE SITE JUNKYARD.SE (RUN BY JUNKYARD TRADING AB) IN a DISPUTE AGAINST BLOCKET.SE

The dispute concerns damages for copyright infringement and non-approved use of photos processed and owned by Junkyard and published on their site junkyard.se.

Blocket has, without prior approval, copied and published Junkyard’s photos on the shopping site blocket.se. Junkyard’s logotype has been removed from the copied photos and customers have, through links directly from the photos, been referred to other commercial sites competing with junkyard.se. Blocket has admitted copyright infringement of 338 of Junkyard’s photos.

A judgment will be delivered by the District Court of Stockholm on October 18. Since there is no detailed case law concerning such a comprehensive commercial infringement of photos,  the judgment will be of great importance.
