Matiss Rostoks successfully represents client in civil claim for damages

In May 2019, in a civil case, where the plaintiff – a Magnusson Latvia client – was represented by a Magnusson Latvia partner, attorney-at-law Matīss Rostoks, the court completely satisfied the claim for damages related to the delay of the deadline for the loading of international freight transportation.

Magnusson Latvia partner Matīss Rostoks, by interpreting the factual circumstances of the case and successfully applying the CMR Convention, proved to the court the factual existence of a Carriage contract prior to the drafting of the CMR invoice and the defendant’s liability for the damages, which were suffered by the Magnusson Latvia client as a consequence of the increase in the price of the cargo to be received in case the defendant would miss the loading. The court, relying on the argumentation of Magnusson Latvia about the liability to cover the damages, decided to satisfy our client’s claim to recover damages in the amount of several thousand euros for the delay of the deadline for the loading of international freight transportation.
