DEPOSIT GUARANTEE FOR A SINGLE MEMBER OF A CONSORTIUM IN POLISH TENDERING PROCEDURE

Bank or insurance guarantee which is paid in the course of contract award procedure in order to secure the deposit offer, may be issued to any member of a consortium.

The conclusion results from the recent judgement of the District Court in Słupsk of 23rd July 2015 (REF: IC Ca 357/15), which disagreed with the interpretation presented by certain adjudicating panels in the National Appeal Chamber (NAC), according to which in order to efficiently secure the interests of the contracting authority, the bank guarantee or insurance guarantee has to be issued to all members of the consortium (and not, for example, to one who is the leader of the consortium). The Court ruled that between the members of the consortium there is a shared responsibility for actions and omissions taken by any member of the consortium. In other words, the effects of actions performed by one of the member of the consortium apply to the entire consortium, thus the deposit guarantee may be issued solely to a single member of the consortium.
