Magnusson has successfully represented Wallhamn AB in the Supreme Court in a dispute regarding blast damage

Magnusson, through a team consisting of Mårten Tagaeus (responsible partner), Johan Sparrman, and Ida Zackariasson, has successfully represented Wallhamn AB in the Supreme Court in a dispute against Cullberg Consulting AB and Lindmarks Åkeri AB concerning compensation for damage caused by blasting.

Wallhamn claimed that the blasting carried out by Cullberg had led to costs for cleaning the area where blast debris had scattered and examining the 748 newly manufactured cars stationed within the area. Cullberg and Lindmarks, on the other hand, contended that the examination costs constituted a non-compensable third-party damage.

The Supreme Court has issued its judgment fully endorsing Wallhamn’s position and thereby dismissing Lindmarks’ and Cullberg’s appeal. The Court holds that the examination costs were incurred as a direct consequence of the damage caused by the blasting, that Wallhamn was responsible for the vehicles, and that the examinations constituted a reasonable and foreseeable outcome of the blast damages.
