What Estonia’s Insolvency Service Can Do for zondacrypto Customers

Zondacrypto’s collapse has all the hallmarks of a case Estonian law reserves special attention for: close to a million users once held funds on the platform, Polish prosecutors estimate losses at roughly 82 million euros affecting some 30,000 people, and Estonia’s Financial Intelligence Unit has revoked the operating licence of BB Trade Estonia OÜ, the company behind the exchange. The founder has been missing since 2022, a coldwallet reportedly holding around 450 bitcoin has been unreachable ever since, and management has declined to publish a proof of reserves. 

Estonian law has a mechanism built for cases like this. Under the Bankruptcy Act, a case is normally discontinued for lack of assets once the debtor has nothing left to cover even the cost of running the process: closed, in effect, before anyone has properly looked into what happened. That changes where the insolvency raises genuine public interest. For instance, a suspected act with the characteristics of a criminal offence, a failure tofile for bankruptcy in time, gross mismanagement, or intentionally or grossly negligently causing insolvency. In such cases, the court can call on Estonia’s Insolvency Service (Maksejõuetuse teenistus), an independentpublic authority, to take the case forward as a “public investigation” instead, funded from its own budget rather than a private deposit. 

This distinction matters, even though it does not change how creditors get paid. Registering a claim within the statutory window is the same step either way. A public investigation means a trustee is appointed and fundedto look into the case even where the company itself has nothing left, tracing where assets went, pursuing clawback claims against harmful transactions, and referring suspected wrongdoing to the prosecutor or seeking a business ban. Any value recovered flows into the same estate creditors are already claiming against. The practical significance is a larger pot to recover from and an active search for what happened. 

That said, whichever route funds the proceedings, individual recovery still depends on being a registered creditor in the estate. Once bankruptcy is declared, you have two months to register your claim.
